Welcome to BHK Marketing. These Terms of Service (“Terms”) govern your use of our website, digital products, and marketing services (“Services”) provided by BHK Marketing (“Company”, “we”, “our”, or “us”).By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.
1. Services Provided
BHK Marketing provides professional digital marketing and lead generation services, including but not limited to:
Paid advertising campaign setup and management (Meta, Google, and other platforms)
Lead generation funnel development and automation
CRM setup, integration, and workflow automation
Branding, content strategy, and ad creative direction
Marketing consultation and performance reporting
We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.
2. Use of Services
You agree to use our Services in compliance with all applicable laws and regulations, including but not limited to:
A2P messaging compliance standards
The CAN-SPAM Act
The Telephone Consumer Protection Act (TCPA)
Data protection and privacy laws
You must not use our Services for any unlawful, misleading, or unauthorized purpose. Any misuse of our systems for spam, fraudulent activity, or deceptive advertising will result in immediate termination of services.
3. SMS & Messaging Terms
If you use our Services to send SMS messages or other forms of direct communication:
All message recipients must have explicitly opted in to receive communications.
Opt-in consent must be recorded and verifiable.
You must include clear opt-out instructions, such as “Reply STOP to unsubscribe.”
Message frequency and content must match your stated disclosures at the time of opt-in.
The disclosure “Message and data rates may apply” must be visible where appropriate.
We do not guarantee message delivery, and neither we nor carriers are liable for delayed or undelivered messages.
4. Client Responsibilities
As a client of BHK Marketing, you agree to:
Provide accurate business information and legal consent for marketing activities.
Ensure compliance with advertising and communication laws in your jurisdiction.
Supply all creative assets, logins, and access credentials in a timely manner.
Refrain from requesting or directing us to create misleading or false advertising content.
5. Payment Terms
All payments for Services are due as agreed in your signed proposal, invoice, or service agreement.
Payment must be made promptly according to the stated schedule.
Late payments may incur additional fees or result in service suspension.
All payments are non-refundable once services have commenced.
We reserve the right to pause or terminate active campaigns and accounts for nonpayment or chargebacks.
6. Intellectual Property
All creative materials, strategies, ads, and marketing assets produced by BHK Marketing remain our intellectual property until full payment has been received.
Upon full payment, ownership of any custom-created content may be transferred to the client as agreed in writing.
Templates, automation systems, frameworks, or proprietary tools remain the property of BHK Marketing.
7. Confidentiality
Both parties agree to keep confidential any business, personal, or strategic information shared during the engagement.
Confidential information will not be disclosed to third parties except when required by law or with prior written consent.
8. Limitation of Liability
Our Services are provided “as is” without any warranty, express or implied.
BHK Marketing shall not be held liable for:
Loss of revenue, data, or business opportunities
Platform policy restrictions or ad account issues
Delays or performance interruptions caused by third-party services (e.g., Meta, Google, or Twilio)
In no event shall our total liability exceed the amount paid by the client for Services during the three (3) months preceding the claim.
9. Termination
We reserve the right to suspend or terminate Services at any time if:
The client violates these Terms
Payments are not made on time
The relationship is deemed unproductive or unethical
